The Trust and Tax Team

Our highly regarded specialist team works with clients on personal tax affairs and the administration of trusts.  Our team remove the stress of completing annual accounts, tax returns, HRMC compliance and dealing with the day to day requests from beneficiaries for funds.   The team is experienced in dealing with the tax affairs of individuals and those who may be a client of our Court of Protection team, whereby a Deputy or an Attorney may act on their behalf. 

The Role

Our Lifetime Planning Team is looking to recruit an experienced Trust & Tax Executive to join the Trust & Tax team who are based in our Fornham office on the outskirts of Bury St Edmunds office.  This is a great opportunity for a candidate with previous experience in trust administration to join a dynamic evolving law firm.

Main duties

Administration of Trusts

  • Administration of Trusts (various including Life interest, Discretionary, Compensation Settlements, Charitable)
  • Liaising with trustees and beneficiaries managing their expectations and dealing with their requests
  • Preparation of IHT 100 forms for Relevant Property Trusts
  • Registration of Trusts on the Trust Register
  • Completion of all documentation where appropriate for the Ashtons Legal Trust Corporation
  • Liaising with trustees and other professionals to build a rapport to develop a clear understanding of the trust objectives
  • Attending Trustees’ meetings as required
  • Documenting release of funds
  • Actively anticipating trust events and considering all planning opportunities from both a tax perspective as well as beneficiary entitlements and circumstances
  • Managing key dates and ensuring they are centrally recorded in line with the firms risk and compliance requirements
  • Reporting to Partners of the firm acting in their capacity as Trustees 

Taxation of Trusts

  • Timely completion of trust tax returns and dealing with HMRC compliance
  • Annual filing online for the Trust Register compliance
  • Preparation of tax certificates
  • Income and Capital Gains Tax advice & calculations
  • Assisting with maintenance of CGT records re investment histories
  • Calculation of IHT in relation to Relevant Property Trusts
  • Organising payments of tax to HMRC
  • FATCA (Foreign Account Tax Compliance Act) compliance and filing of annual returns

Personal Taxation

  • Completion of Personal Tax returns, in connection with Bare Trust Settlors/Beneficiaries
  • Completion of and assisting colleagues with income tax and capital gains tax compliance
  • Providing advice and assisting clients with the queries referred by the other teams

General Tasks

  • Keeping and maintaining records for the conduct of the matters and files
  • Maintaining each client file in a proper manner in accordance with the requirements of the Firm to comply with the Law Society and ISO
  • Arrange appointments and interview clients and others where necessary
  • Liaise with the clients either directly, face to face or by telephone and deal with any queries relevant to the client
  • Maintain accurate Time Recording records in accordance with the Firm’s policy
  • Maintain Clients Account in accordance with the Solicitors Accounts Rules and in liaison with Accounts/Finance Department
  • Manage an effective diary system using Outlook/Peppermint highlighting milestone dates on each matter
  • Ensure all letters, forms, paperwork and communication are completed accurately and on time
  • Complete and follow up all documents in relation to accounts, cheque requisitions and banking for client matters
  • Carry out additional duties to assist the department including business development and marketing initiatives
  • Flexibility is required in order to support the Lifetime Planning team and carry out any reasonable duties as may be directed by the Partners or Management of the Firm

Knowledge, skills and experience required

  • STEP membership an advantage but not essential
  • ATT/CIOT qualification or other tax qualification an advantage
  • Experience in trust and personal taxation, to include IHT, CGT and Income Tax and their relevance to Trusts and their administration
  • HMRC compliance
  • Knowledge of the preparation of annual Trust Accounts 
  • Sound working knowledge of Microsoft office, Word and, in particular, Excel
  • Knowledge of case management system is desired, but training can be provided
  • Flexible approach to work
  • Good planning, organisation and time management
